These are the terms that govern the use of this site, Propor.com.au. They serve as an agreement between Propor.com.au and our users. By using this website, it means that you agree to our terms and conditions (including our Privacy). If you do not agree to the terms, do not use or access this website.

We reserve the right to change our terms and conditions at any time and without prior notice by publishing the new terms on the Propor website. If you choose to continue using or accessing our website, it means that you are bound by such new terms and conditions. If you do not agree to the new terms, you must immediately stop using or accessing the website.

Overview

This website hosts the Propor tool, which gives buyers and sellers the opportunity to gauge the market with a view to possible future real estate transactions. Below is a brief description of how the Propor tool works:

1. Propor tool allows potential Buyers to glance through off-market properties that have been listed by owners and real estate agents on the website.

1. The properties that the potential Buyer sees are based on the specific search criteria entered by the potential buyer and are color-coded to based on what your search criteria is and what properties are in the system.

1. If a potential Buyer is interested in a property, the tool lets that person view the details of the property in question and request the address of the property. The agent or owner of that property is notified of the request.

1. The agent or owner of the property in question reserves the right to accept or reject the request to view the property.

While Propor provides the Propor tool, we do not take any responsibility for:

1. any information posted or transmitted by users through the platform, including the descriptions and prices of listed properties;

1. any interactions between users (including any interactions between Buyers and Selling Agents); or

1. Any transactions that are brokered through or otherwise arising out of, use of the website, or the platform.

We will make all reasonable efforts to ensure that accuracy and completeness of the information on the website that is provided by us (including any information in any Propor newsletters, offers or notifications) to the extent permitted by law, we give no warranty that such information is accurate, complete or up-to-date.

We are not responsible for and accept no liability with respect to any material made available on the website by another user or by any person other than Propor. We do not endorse any opinion, advice, or statement made by any person other than Propor.

You are advised to make your own assessment about the accuracy, currency, and suitability of any information accessed via the website (or in any of our newsletters, offers, or notification) for your own purposes. To the extent permitted by law, we exclude liability for any information on the website (or in any Propor newsletter, offer, or notification) that contains errors or is out of date.

Membership

Membership on this site is open only to Australian residents. Non-residents are advised not to register on the Propor platform for any of the services related to Propor.com.au.

By using the website or associated services, you warrant and represent to us that:

1. you are 18 years of age or older, or if you are under the age of 18, you have obtained the prior consent of your parent or guardian to access and/or use the website;
2. any information you submit is truthful and accurate, and that you will keep your account information up to date; and
3. your use of the website and associated services does not violate any applicable laws or regulations.

For real estate agents you warrant that:

1. you are a licensed and registered real estate agent
2. you have the permission of your agency to use the agency’s logo and name; and
3. you are authorized by the seller of the property and your principal to list any property on the platform.

We are not obliged to accept every application to join the platform. We may also take such steps as we deem necessary to verify the identity of any applicant. Terminating your account does not in any way affect any rights or obligations which have accrued under the Direct Agreements between your agency and Propor. It is against our terms for you to transfer or assign your account to another user. Similarly, you cannot use another person’s account, username or password to access the site.

Purpose of use

The site is mostly used to showcase off-market listings. Therefore, once a property has become listed as an on-market property, it should be taken off the platform.

For Buyers, it is understood that access to the platform is for your personal use and not for commercial use.

As an agent, you agree to ensure that any information you upload to the platform is accurate, complete, and lawful and that you are not in breach of any law or regulations. Also, you warrant that you will not use the platform or services to spam, stalk, or otherwise harm any member, and you will not use it in an unauthorized manner.

You agree to indemnify and hold Propor and its affiliates (and their officers, agents, partners, and employees) harmless against any and all loss, liability, claim or demand (including reasonable legal fees) which might be as a result of the way you have used or accessed our platform or otherwise breaching these terms of use.

To the extent permitted by law, Propor’s liability for breach of any implied warranty or condition that cannot be excluded is restricted, at our option to the re-supply of services or what it cost to pay for a re-supply of services.

You acknowledge and agree that Propor will not be liable to you or any third party for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, revenue, goodwill, customers, or capital in any way connected with these terms or the Propor Platform.
